1. General
The conditions of sale set out below shall apply to all sales by Nortrade Industrial Supplies ("Seller") to each customer ("Buyer"). The Buyer acknowledges that by accepting a quotation from the Seller, submitting an order to the Seller, submitting an account application form to the Seller or accepting a delivery of goods from the Seller y, the Buyer shall be deemed to have accepted these conditions of sale and agree that they shall apply to the exclusion of all others.

2. Orders and Prices
Any order placed by the Buyer in the manner described on this site is an offer to purchase a particular product or service for the price (including the delivery and other charges) specified on this site at the time the Order is placed. It is acknowledged that, by placing an order, the Buyer is agreeing to pay for and accept delivery of the goods ordered unless the Order is cancelled in writing, prior to the goods being dispatched to you.

Nortrade Industrial Supplies may change the prices published on this website at any time without notice. While every effort has been made to ensure the accuracy of prices and information displayed on the Nortrade Industrial Supplies? website, the Seller reserves the right to accept or reject any offer for any reason, including, without limitation, the unavailability of any product, an error in the price or the product description posted on this site, or an error in a Buyer?s order. Additional verification or information may be required before accepting an order.

Where permitted, we reserve the right to limit sales, including the right to prohibit sales to re-sellers. We are not responsible for typographical or photographic errors on this site, including any such errors in relation to prices.

All prices are exclusive of GST. Prices advertised on this site are for Internet orders only. Prices on some items may differ from those listed in the hard copy of the Store?s Catalogues. Site Information is current at the time of issue, but Prices and Availability of items as displayed on this site are subject to change without notice. Prices displayed on this site are current at the time of issue, but may change at any time and are subject to availability. Nortrade reserves the right to limit sales, including prohibition of sales to Re-sellers. No responsibility is accepted for typographical or photographic errors on this site, including any such errors in relation to prices.

International or Offshore Orders: These Terms & Conditions, as well as policies on Delivery & Returns, are not always applicable to Sales outside Australia. This applies particularly to Freight Charges (which will vary country to country), the Voltage of Power Tools (which are 240 volt Australian) and payment of GST, VAT or other Duties and Taxes specific to a Country. Therefore, International Purchasers are warned to confirm Pricing and Suitability of Goods prior to offering payment.

3. Payment
Unless a credit account has been approved payment shall be made in advance by Credit Card or EFT. Credit terms for Account Customers are net cash 30 days from invoice date. The Company reserves the right to vary payment terms or withdraw approval of a credit account at any time. No credit shall be extended on overdue accounts, except by prior written agreement with the Seller.

With a 30-day account we will ship your order with an attached Delivery Docket as soon as Stock is available, and then send the invoice to you by mail. To apply for an account please download and forward to us a credit application form. The Seller reserves the right to refuse offering an Account without reason being given.

Currently, the Seller's policy is not to charge a merchant fee on any Credit Cards. The Seller reserves the right to charge a merchant fee in the future.

4. Risk and Ownership
The risk in all goods shall pass to a Buyer on delivery by the Company. Ownership in the goods shall not pass to the Buyer until all moneys owing by the Buyer to the Company on any account have been paid. Until property shall pass to the Buyer the latter shall hold and maintain the goods as bailee of the Seller in the packaged and identifiable form in which the goods were delivered. The Buyer irrevocably authorizes the Seller to enter on any premises occupied by the Buyer without previous notice to the Buyer and to re-take possession of the goods if the Buyer shall;

• Default in payment of any moneys due to the Seller or
• Commit an act of insolvency or bankruptcy

5. Liabilities and Warranties
To the extent permitted by law, the Seller will not be liable, in contract, tort (including negligence) or otherwise, for any direct, indirect, special, consequential or punitive loss or damages or any loss or damages whatsoever including (but not limited to) loss of use, data, or profits, arising out of or in connection with;

• The use, copying, or display of the contents of this site;
• Goods or services supplied by the Seller under these Terms and Conditions;
• A failure or omission on the part of the Seller to comply with its obligations under these Terms and Conditions

The Seller accepts no liability for the Customer's security breaches, unauthorized use of the Buyer's credit account, fraud, forgery or mistaken or unauthorized orders or payments.

The Seller reserves the right to revoke access to our website at any time.

The Buyer?s password and access details are strictly confidential information and must not be disclosed to, or used by, any person except for those employees of the Buyer with a 'need to know' for the purposes of placing orders with the Seller. The Buyer must release all confidential information to the Seller on termination of its relationship with the Seller.

6. Applicable Law
These terms and conditions are governed by and will be construed in accordance with the laws of the Northern Territory of Australia and the parties agree to submit to the jurisdiction of the courts of that Territory, or in accordance with Federal Law, where the Territory Laws are silent on any issue.

7. Delivery Details
All products ordered that are currently in stock will be despatched on the same day or the next day. Please allow between 4-8 working days for delivery* (depending on destination address & freight option chosen) from the date of despatch of your order. All products that need to be ordered in by Nortrade from a Supplier will take a further 4-8 days prior to despatch. Cash on Delivery (COD) orders are not accepted.
